DASHCAM INSTALLATION SERVICES – LIABILITY WAIVER AND RELEASE OF CLAIMS

RELEASED PARTIES:
– Aleksandr Oreshkin (Individual Technician)
– Cyber System Technologies LLC (Nevada Limited Liability Company, Douglas County, Nevada)

AGREEMENT TERMS

The Vehicle Owner acknowledges that they are requesting professional dashcam installation services and understands and accepts the following terms:

SCOPE OF SERVICES

Cyber System Technologies LLC will install one dashcam unit in the vehicle. Installation includes:
– Routing wiring through vehicle interior panels and dashboard areas
– Connection to vehicle electrical systems
– Mounting of the dashcam device
– Testing of functionality
– Any other work necessary to complete the installation

RISKS ACKNOWLEDGED BY VEHICLE OWNER

The Vehicle Owner understands and accepts the following risks associated with dashcam installation:

ELECTRICAL RISKS
Dashcam installation may result in:
– Battery drainage or depletion
– Blown fuses
– Electrical short circuits
– Damage to vehicle electrical components (infotainment systems, dashboard displays, power window systems, lighting systems, or other electrical equipment)
– Complete or partial electrical system failure
– Fire hazard (rare circumstances)
– Corrosion or oxidation of electrical connections

The Vehicle Owner accepts all risk of such electrical issues, discovered immediately or in the future.

PHYSICAL DAMAGE TO VEHICLE
Installation work may result in:
– Scratches, scuffs, marks, or discoloration on interior plastic components
– Damage to door trim panels, dashboard trim, steering column covers, or similar materials
– Marks, impressions, or indentations caused by pry tools, clips, or installation equipment
– Damage to wiring harnesses, clips, or connectors
– Dents, cracks, or breaks in interior components
– Paint chipping or peeling
– Upholstery damage or staining
– Window or glass damage
– Loss or misplacement of hardware or fasteners

The Vehicle Owner acknowledges that such damage is sometimes unavoidable and accepts all risk of such damage.

DEALERSHIP AND WARRANTY ISSUES
The Vehicle Owner understands that:
– Some vehicle manufacturers and authorized dealerships may refuse service or deny warranty coverage for vehicles with aftermarket accessories, including dashcams, even if the dashcam installation did not cause the issue
– Dealerships may charge additional diagnostic or service fees related to dashcam interference or electrical issues
– Installation of aftermarket electronics may void certain manufacturer warranties or extended service plans
– Aleksandr Oreshkin and Cyber System Technologies LLC are not responsible for any costs, claims, or disputes arising from dealership non-service or warranty denial

The Vehicle Owner accepts all risk of dealership-related consequences.

HIDDEN OR LATENT DEFECTS
The Vehicle Owner understands that the vehicle may have pre-existing electrical issues, component defects, or vulnerabilities that could interact unfavorably with the dashcam installation. Aleksandr Oreshkin and Cyber System Technologies LLC have not performed comprehensive pre-installation diagnostics. The Vehicle Owner accepts all risk that the dashcam installation may trigger, worsen, or interact with pre-existing vehicle defects.

UNKNOWN OR UNFORESEEN RISKS
The Vehicle Owner acknowledges that automotive work inherently involves risks that may not be fully foreseeable. The Vehicle Owner accepts all risk of such unknown or unforeseen consequences.

COMPLETE RELEASE AND WAIVER

The Vehicle Owner hereby fully releases and waives all claims, demands, causes of action, suits, damages, liabilities, costs, and expenses of any kind, whether known or unknown, arising from or relating to:
1. The dashcam installation services provided
2. Electrical damage, electrical system failure, or electrical malfunction of the vehicle
3. Physical damage to the vehicle (scratches, scuffs, marks, dents, cracks, damage from pry tools, or other damage to vehicle interior or exterior)
4. Failure of vehicle systems or components (electrical systems, engine systems, transmission, braking systems, lighting systems, infotainment systems, or any other vehicle component or system)
5. Dealership service refusal, warranty denial, service delays, or any costs, fees, or disputes with automotive dealerships or manufacturers
6. Diminution in vehicle value or trade-in value
7. Loss of use of the vehicle
8. Inconvenience, loss of time, or loss of opportunity
9. Indirect, incidental, consequential, or punitive damages
10. Any injury, death, or property damage to any person or third party arising from the dashcam installation or operation
11. Fire, explosion, or catastrophic failure of any vehicle system
12. Data loss, privacy issues, or misuse of dashcam footage
13. Any other claim, demand, or cause of action arising from the dashcam installation services

This release applies to Aleksandr Oreshkin individually and Cyber System Technologies LLC, as well as their respective officers, directors, members, employees, agents, representatives, successors, and assigns.

WAIVER OF UNKNOWN CLAIMS

The Vehicle Owner explicitly waives any claims that may be unknown, unanticipated, or yet to emerge.

GROSS NEGLIGENCE AND INTENTIONAL MISCONDUCT

Nothing in this Agreement shall release or waive claims arising from:
– Gross negligence or willful misconduct
– Criminal conduct or violations of law
– Intentional misrepresentation or fraud
– Violation of the Vehicle Owner’s civil rights

However, ordinary negligence, simple mistakes, or minor departures from best practices are covered by this waiver, provided the Released Parties acted in good faith and with reasonable care.

GOVERNING LAW AND JURISDICTION

This Agreement is governed by the laws of the State of Nevada, without regard to conflicts of law provisions.

The Vehicle Owner agrees that:
– Any and all claims shall be brought exclusively against Cyber System Technologies LLC and not against Aleksandr Oreshkin individually
– Exclusive venue is in the District Court of Douglas County, Nevada, or the United States District Court for the District of Nevada
– The Vehicle Owner waives any claim that venue in Douglas County, Nevada is improper or inconvenient
– The Vehicle Owner consents to personal jurisdiction in Douglas County, Nevada
– The Vehicle Owner waives the right to jury trial
– The Vehicle Owner waives the right to participate in any class action or class arbitration

SEPARATE ENTITIES

The Vehicle Owner acknowledges that:
– Aleksandr Oreshkin is performing services as an employee/representative of Cyber System Technologies LLC
– If any dispute or claim arises, the Vehicle Owner’s exclusive remedy is against Cyber System Technologies LLC
– The Vehicle Owner waives any claim, judgment, or collection action against Aleksandr Oreshkin individually
– Cyber System Technologies LLC is a separate legal entity registered in Nevada with principal operations in Douglas County, Nevada

BINDING NATURE

This Agreement is binding and enforceable against the Vehicle Owner, their heirs, executors, administrators, successors, assigns, and personal representatives. This Agreement binds all parties who may have claims arising from the dashcam installation, including family members, passengers, insurance companies, or other third parties with an interest in the vehicle.

If any provision of this Agreement is found unenforceable or invalid, all remaining provisions shall continue in full force and effect.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties regarding liability and damages arising from the dashcam installation services. No oral agreements, representations, warranties, or modifications shall be binding unless made in writing and signed by both parties.

VEHICLE OWNER ACKNOWLEDGMENT AND REPRESENTATIONS

The Vehicle Owner represents and warrants that:
1. The Vehicle Owner is the legal owner of the vehicle or has authority to consent on behalf of all vehicle owners
2. The Vehicle Owner has read and fully understands this Agreement
3. The Vehicle Owner has been given the opportunity to consult with legal counsel regarding this Agreement
4. The Vehicle Owner enters into this Agreement voluntarily and with full understanding of its consequences
5. The Vehicle Owner is not under duress or undue influence
6. The Vehicle Owner acknowledges the release of substantial rights by signing this Agreement
7. The Vehicle Owner acknowledges that the performance of dashcam installation services constitutes valuable consideration for this release and waiver
8. The Vehicle Owner would not receive the dashcam installation services without signing this Agreement
